1. Who you are contracting with

These Terms form a binding agreement between you and Movie Madness ("Movie Madness", "we", "us") for your use of the Movie Madness website and application (the "Service"). Seller legal business name: Movie Madness.

2. Acceptance

By creating an account, purchasing access, voting, creating brackets, browsing the Service, or otherwise continuing to use the Service, you agree to these Terms. If you do not agree, do not use the Service.

3. Your account

You are responsible for the activity that happens under your account and for keeping your credentials confidential. You must provide accurate information and keep it up to date. You must be of legal age in your jurisdiction to enter into these Terms, and if you use the Service on behalf of an organisation, you confirm that you have authority to bind that organisation.

4. Acceptable use

You must not misuse the Service. In particular, you must not:
  • Use the Service for any unlawful, fraudulent, or harmful purpose.
  • Send spam, manipulate voting, or harvest data about other users.
  • Infringe anyone's intellectual property, publicity, or privacy rights.
  • Probe, scan, scrape, disrupt, or interfere with the security, availability, or integrity of the Service, or attempt to bypass technical limits.
  • Upload malware or other harmful code.

5. Intellectual property

The Service, including its software, design, branding, documentation, and other intellectual property, is owned by Movie Madness or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have purchased. You may not reverse engineer, resell, redistribute, or circumvent access controls for the Service.

6. User content

You retain ownership of the tournaments, brackets, votes, predictions, comments, and other content you create. You grant us a limited license to host, store, display, process, and transmit that content solely so that we can provide, protect, and improve the Service. You are responsible for ensuring you have the rights needed to submit your content.

7. Payments, subscriptions, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Prices, billing frequency, subscription renewals, cancellations, tax, checkout, payment processing, and refund mechanics are governed by Paddle's Buyer Terms. See our Refund Policy for our refund window and how to request a refund.

8. Service availability

We work to keep the Service running smoothly, but we do not guarantee that it will be uninterrupted, error-free, or available at all times. Features may change as we improve the Service.

9. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts due, present a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time. After access ends, we may retain or delete data as described in our Privacy Notice and as required by law.

10. Disclaimer and liability

To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind. Our aggregate liability arising out of or in connection with the Service is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.

11. Changes

We may update these Terms from time to time. If we make material changes we will take reasonable steps to notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
